David Bailey will discuss the evolving case-law on the standard of proof and standard of review in the courts of the United Kingdom. The UK Government is currently consulting on whether to change the standard of review in competition and regulatory appeals. He will therefore discuss, in particular, the differnces between ‘appeal on the merits’, on the one hand, and judicial review, on the other.
